Time for trademark registration
How long does it take to register a trademark?
If you want to register a trademark, we recommend that you optimize the time spend for registration by requesting a preliminary documentary research which would give you a clear idea of your chance of success in registering the trademark. You will also find out if there are any legal reasons for oppositions and you can proceed accordingly for the continuance of the procedures – submitting a new application or modifying the initial one if this is the case.
After the preliminary documentary research, the following steps are taken:
- Submitting the registration application at the Romanian Office for Inventions and Trademarks and attaching a serial number to your trademark;
- Formal examination of the registration application and its publication in the ‘Industrial Property’ Official Gazette (IPOG) – the request section;
- Examination as to substance of the trademark;
- Trademark registration and its publication in the ‘Industrial Property’ Official Gazette (IPOG) – the trademark publication section.
Approximately eight months will pass between the moment of submitting the registration application at the Romanian Office for Inventions and Trademarks (ROIT) and the moment the trademark registration certificate is issued.
In case third parties oppose or dispute the trademark registration, the time it takes to complete the process (registering the trademark) can be prolonged extensively, up to 2 years.
What is the validity of a trademark?
The trademark registration is in effect for 10 years since the moment of the first filing. The renewal of the trademark registration can take place every ten years and it requires taking care of the tax payment imposed by the law.
