TRADEMARK RENEWAL

The trademark registration is in effect for 10 years since the moment of the first filing.

The renewal of the trademark registration can be requested before the expiration date of the current protection, but not sooner than 3 months prior to this expiration date. The renewal of the registration cannot bring essential modifications to the trademark.

Important!At the request of the title character, the registration of the trademark can be renewed every 10 years and it requires taking care of the tax payment imposed by the law.

The renewal application of the trademark registration will comprise:

  • The express solicitation for the renewal of the trademark registration;
  • The ID information of the title character and if it is the case, the trustee's name, home address and office;
  • The trademark registration number from the National Register of Trademarks;
  • The first filing application for the trademark;
  • The signature of the title character, the authorized person or of the trustee, according to case;
  • The evidence of having paid the fee imposed by the law upon trademark registration renewal.

When the title character requests the renewal of only some products and services included in the National Register of Trademarks, s/he will mention the name of these products and services for which the trademark registration renewal is requested.

If the renewal request (submitted within the established terms) does not contain one of the elements imposed by the law, the State Office for Inventions and Trademarks will notify the applicant of the irregularities encountered and will grant a three-month term for their remedy. If no action is taken within this period of time, the trademark registration renewal application is rejected. The applicant has the possibility to dispute this decision of rejection.

Throughout the trademark protection, the title character can request from the State Office for Inventions and Trademarks the introduction of unessential modifications of some elements of the trademark (including the name and address of the title character) but with the condition that such modifications will not affect the overall image of the trademark.

If the renewal request meets all the legal conditions, the State Office for Inventions and Trademarks (SOIT) will issue a renewal certificate and will communicate it to the title character.

The renewal of the trademark is registered at the National Register of Trademarks and it is published in the 'Industrial Property' Official Gazette (IPOG) in 6 months' time since the renewal request is submitted at the State Office for Inventions and Trademarks.

Important! The renewal for the trademark registration is in effect starting the day after the expiration date of the current period of protection.
